Selected Opinions

All opinions of the Court of Appeals, both published(which have precedent value) or unpublished can be found on the North Carolina courts web site which is www.nccourts.org. I have authored over 800 such opinions. Here I have published the following opinions which are representative of my work as an appellate judge. They are:

State v. Pelham Filed: 4 May 2004  Upheld conviction of drug dealer who fired on sheriff's deputies attempting to execute a search warrant on his trailer in Brunswick County.

State v. Hill Filed: 5 Nov. 2002  Reversed Trial Court's order that Sheriff return money seized from suspected drug dealers from his own budget after funds were turned over to DEA agents for forfeiture in federal court.

Stilwell v. General Railway Services Filed: 7 Dec. 2004  Reversed Trial Court's directed verdict for defendant thus denying injured railway worker opportunity for jury to decide his case.

Revels v. Miss America Org. Filed: 20 Mar 2007  Upheld dismissal of Plaintiff's claim that she should retain Miss North Carolina title despite her failure to comply with court-ordered discovery of photos of plaintiff in compromising positions taken by former boyfriend with a protective order maintaining only defendant could view same.

Shavitz v. City of High Point Filed 16 May 2006  Held that proceeds from "red light camera" enforcement program belonged to the schools less 10% administrative cost under N.C. Constitution and not to the city.
